Update: Dem Activist Scott Markle’s Federal Child Porn Indictment

I first blogged about Scott Markle over the weekend. If you will recall Markle is a Democratic activist, a Martin O’Malley (donor, and a registered sex offender. Markle and his wife, Corynne Courpas, have been long-time Democratic Party activists and cronies of Governor O’Malley.

Markle was accused of possessing child pornography in 2002 and pleaded guilty. He was sentenced to a year in federal prison and got out in 2006. He then went on the state’s Sex Offender Registry. He was also previously a drug informant.

In February, Markle was indicted for possession of child pornography by a federal grand jury. He was charged with failing to update his address for the Sex Offender Registry in March (those charges were dismissed recently.)

Markle was indicted on February 21. That was the date of the February meeting of the Carroll County Democratic Central Committee. Markle had been in attendance at those meetings as a guest going back for a year or more and often spoke in his role as President of the County Democratic Club. While he was not at the February meeting, his wife was listed in the minutes. I’d also heard that in the past, Democratic politicians including Lt. Gov. Anthony Brown skipped events for the Carroll County Democrats that were held at the Markle-Courpas home in Westminster.

The March charges on failure to update his address were what landed Markle in the news the past couple of weeks. The address he changed it to on March 15 is an address in Taneytown that appears to belong to his parents. He had previously lived in Westminster with his wife.

Based on circumstantial evidence above, it would appear that he was kicked out of the house by his wife. I’ve heard recently that she filed for divorce, but I’ve found no evidence of that happening yet in Maryland Case Search.

He and his wife have been married since 1994. She stayed with him before  after the 3 years between accusation and conviction then a year in prison for possession child pornography. It appears that for now she is not sticking by him this time.

Other records related to his current federal charges are a motion to suppress evidence (at the bottom of this post) and a financial affidavit that is not available to view. Based on his counsel’s information in the motion, he qualified to have the Federal Public Defender represent him. Does he qualify for a public defender because of the fact that his wife kicked him out and he may have lost his job (working to confirm or refute that information) at Catoctin Counseling Center?

The motion to suppress evidence filed in April seeks to throw out a statement that the government claims was made by Markle. His attorney claims that the statement violates his 5th and 6th amendment rights because he was not read his rights, was in a custodial setting, and the statements weren’t made freely, voluntarily, or knowingly

In Markle’s previous conviction he admitted to federal officials that he had the material on his work computer, and his lawyer Gregg Bernstein told the media how much he had cooperated with authorities. His attorney this time seems to be taking a different tack.
